While the Temporary Resident Visa (forms IMM 5256) may seem to be virtually the same as the TRV application (forms IMM 15444), the names alone are confusingly similar. American who wish to travel to Canada with a DUI charge may well be considering a Temporary Resident Visa rather than a TRV application. As a matter of fact, you may be better off applying for both.
The reason for this is that the two forms of these two different visas are targeted for two different classes of people. Whereas the Temporary Resident Visa is specifically for individuals with criminal convictions, the TRV program is targeted at those with DUI convictions.
As such, there are specific eligibility requirements for each. Both have a minimum period of time from the date of conviction for an eligible applicant to apply for either one, but there are differences in the length of time for each one.
In order to qualify for the permanent resident status through the permanent route you will need to meet a number of requirements, including having a job offering wages which will support you while in Canada. This is referred to as Employment Support under the Federal Balanced Budget Act.
You must also be in receipt of Security Benefits and have reached the age of 65. Along with meeting these requirements, you must have a valid passport issued by a foreign country and can remain in Canada for three years after your initial admission.
Finally, you must prove that you have paid all applicable taxes and that you meet all other residency requirements. These are all the criteria necessary to successfully apply for a temporary resident visa to Canada.
As you can see, you must first become eligible through the Federal Balanced Budget Act before applying for a visa. This ensures that the financial requirements are met.
Once you have met the criteria, you will need to apply for a temporary resident permit at the customs and immigration services office of the area where you intend to enter Canada. The Consulate General of Canada will be able to provide you with information on how to do so.

For example, an American who is seeking Canadian citizenship may need to apply for an EAD to prove that they have acquired the three-year work experience that is required for eligibility to stay in Canada.
An Employment Authorization Document is valid for a specified period of time and cannot be renewed. Once you reach the expiration date on your EAD, you will have to obtain a new one or start the process all over again. If, however, you are a United States citizen and are eligible for permanent residency in Canada, you may be able to apply for a Canadian citizenship certificate.
The fourth type of Immigration Visa that you will find quite common among those seeking a Canadian temporary resident permit are those who have either no criminal record in the United States or a minimal criminal record.
Although some have problems establishing themselves in either country, many choose to live in the United States while working and then eventually establish their status in Canada. As an example, some choose to move to British Columbia (which, ironically, has one of the highest rates of crime in the country) and then later move back to the United States.
Or, they may decide to live in New Hampshire and then later move to another state, such as California. However, there are certain states that do not require an immigrant to prove their Criminal Record, such as Arizona.
There are many other reasons why people choose to live and work in Canada, rather than in the United States. One of the most important benefits is that it is much easier to find employment in Canada.
Most employers prefer to hire those individuals that have been educated in the language of the country they are visiting. Therefore, an individual who is fluent in two languages including English is often much more desirable to an employer than an individual who has only one language.
